On the surface, it?s easy to shrug at Sunday?s slate of games, given the sense that only a few postseason loose ends remain.? But as our good friend Ricky Diamond, producer extraordinaire at NBC Sports, points out, all but three of the games have meaning.

Unfortunately for FOX, all three of the meaningless games ? Redskins-Eagles, Bears-Vikings, Seahawks-Cardinals ? will be televised on its network.

Here are the implications of each of the other games.

Bills at Patriots:? New England clinches the top seed in the AFC with a win.? A loss combined with a win by the Steelers or Ravens would push the Pats to No. 2.

Jets at Dolphins:? New York remains alive for the second wild-card berth in the AFC.

Titans at Texans:? Ditto for the Titans.

Colts at Jaguars:? The Colts secure the No. 1 pick if they lose; if they win (and if the Rams lose to the 49ers), the pick goes to St. Louis.

Ravens at Bengals:? The Ravens need a win to clinch the AFC North and the No. 2 seed.? The Bengals must win to secure the second wild-card berth in the AFC.

Steelers at Browns:? A Steelers win plus a Ravens loss gives Pittsburgh the AFC North title and the No. 2 seed.? Throw in a Patriots loss, and the Steelers emerge with the No. 1 seed.

Chiefs at Broncos:? Denver clinches the AFC West with a victory.

Chargers at Raiders:? Oakland takes the AFC West with a victory and a loss by the Broncos.? The Raiders with a win also have a shot at the second AFC wild-card berth.

Panthers at Saints:? The Saints can capture the No. 2 seed in the NFC with a win and a 49ers loss.

Buccaneers at Falcons:? With a Falcons win and a Lions loss, Atlanta secures the No. 5 seed in the NFC, avoiding a potential return trip to New Orleans.

Lions at Packers:? With a win, the Lions clinch the fifth seed, avoiding the Saints in the wild-card round.

49ers at Rams:? A win by San Fran nails down the No. 2 seed; a loss by the Rams could deliver the top pick in the draft, if the Colts beat the Jaguars.

Cowboys at Giants:? A true playoff play-in game, the winner takes the NFC East.? The loser goes home.

Microsoft Windows Phone Platform Hits 50 Thousand Apps Milestone

Microsoft Corp. has announced that 50 thousand of applications are now available on its marketplace for Windows Phone 7/7.5 platforms. The company is still dramatically behind Apple App Store and Android Market with 500 thousand and 300 thousand apps, respectively. But the software giant remains optimistic and hopes that the battle for smartphones is not lost.

The Windows Phone Marketplace has now passed the 50 000 app and games submission mark. Content is being added at the rate of 265 items per day. At press time, 50 126 items have been published. Of these, 17 276 were added in the last 90 days and 8 010 were added in the last 30 days. It took just over a year to get to 40 000 apps, but just 40 days to add the next 10 000 apps, according to Microsoft.

The last few weeks have seen an acceleration in the rate of submissions. There are two likely causes here: firstly the expanded availability of the Windows Phone Marketplace geographically (extended from 16 to 35 countries) and secondly the release of Nokia's first Windows Phone devices.

Entertainment is the single biggest category (7543 items). the next three biggest categories are books + reference (7014 items), games (6991) and tools + productivity (6797 items). The four biggest categories (out of seventeen) make up 57% of the content.

The majority - 58% - of items in the Windows Phone Marketplace are free, 14% are paid with a free trial and 29% are paid. By comparison, the free / paid ratio for Android is approximately 69% / 31% and for iOS is approximately 43% / 57%.

Windows Phone has taken just under 14 months to reach the 50,000 milestone. Android took 19 months (October 2008 - April 2010) to reach 50 000 apps, reflecting Android's relatively slow start in terms of device licensees. iOS took 12 months (July 2008 - June 2009) to reach the same figure, but arguably had an advantage, given it had an installed based of around 4 million first generation iPhones before the App Store launched.

Although Windows Phone platform commanded 1.5" smartphones in Q3 2011 and the operating system is not that attractive to developers as its competitors, Apple iOS and Google Android, Microsoft claims that availability of 50 000 apps suggest Windows Phone Marketplace is a credible challenger to both Apple's App Store and Google's Marketplace in terms of app metrics.

SB Nation: Deaths pulled hockey community together

ESPN ignored a full year of hockey tragedy in their 2011 Year in Review segment. But as coverage of the game shifts, it's time to realize that ESPN doesn't control the message anymore. Average fans do.

Dec 27, 2011 - I'm not one of those hockey fans that feels ESPN should treat us like first-class citizens. I'm obviously an advocate for our sport and somebody that thinks hockey is far superior to baseball, football, basketball or any other game that's played on the planet, but I'm also not out of touch.

I realize that hockey fans are in the minority, and that as long as it's an expensive game to play and a complicated game to understand, the sport will never catch on the way basketball or football or baseball have. When I was a kid, it was $25 a season to play baseball. Hockey was nearly $1,000 a season. It's just sort of the way it is. Hockey will never match up in popularity in places where you can't just pick up a puck and a stick and go play on the pond, and as a result, the NHL will never be as popular as MLB or the NFL. If you haven't resigned yourself to that yet, you should do it now.

At the same time, ESPN is still a news organization, and their embarrasing refusal to cover even the most obvious hockey stories via their television product was on full display over the Christmas holiday, when they aired their annual Year In Review special. In that special, they honor athletes who have passed away in the last calendar year, and despite the tragic year the hockey family suffered, we were completely ignored by the Worldwide Leader in the 2011 edition.

ESPN aired their tribute to athletes who have died in 2011.

Not a single hockey player was mentioned.

So, here, I would like to pay tribute to those players of the sport (whether active in 2011 or not) and any dedicated staff members who passed away. The crew killed on the Lokomotiv Yaroslavl plane crash is included as well.

Mention anyone who is missed, and they will be added.

Remember those who were lost. They are part of our world as hockey players. ESPN forgets, but we will not.

What followed was a lengthy list of members of the hockey community who passed on in 2011, crowdsourced by readers from all across the Internet. It's a remarkably long list that included both active players, coaches, scouts and others, as well as those who were no longer active at the time of their death.

Its length is both tragic, message-sending, and oddly therapeutic. The rest of the sports world may have forgotten about the tragic deaths of Derek Boogaard, Rick Rypien and Wade Belak, or the shocking tragedy that was the loss of the entire Lokomotiv Yaroslavl hockey club.

They may not have ever even heard of Mandi Schwartz, the Yale womens hockey player who lost her inspring battle with leukemia, in April. They may not have remembered the life of E.J. McGuire, the highly-respected head of NHL Central Scouting, who also passed from cancer in April, or that of Harley Hotchkiss, the NHL owner responsible for bringing the league to Calgary.

But that's the therapy of it. They might not have remembered, but we remember. In light of a slap in the face from THE trendsetters in American sports media, the hockey community has come together and said that they won't be ignored.

Luckily, we live in a time when we don't have to be ignored, even when the so-called Worldwide Leader In Sports does just that. More than ever, that "hockey community" today doesn't include just players, coaches, front office staff and owners. It includes you, me, and that guy with the tattoos that sits in the sixth row of Section 127.

The lack of hockey coverage from networks like ESPN is disappointing and at times insulting, but it's forced the NHL to get creative in how they view the media. Five years ago, I was an average fan of the Philadelphia Flyers, and now, I've attended NHL Drafts, All-Star Games, the Stanley Cup Final, two Winter Classics and countless regular season games as a member of the media.

I don't say this to toot my own horn, because we have an entire network of writers that have the had the similar opportunities. In every case, those chances to embed average fans inside NHL locker rooms have hopefully brought other average fans closer to the sport they love.

We're not the only ones doing it, either. Puck Daddy at Yahoo! Sports has become a must-read for hockey fans, as has Pro Hockey Talk at NBC and countless team blogs around the web that aren't part of the SB Nation network. NHL.com is, for my money, the best league-run website on the Internet, NHL Network is consistently improving their coverage, and the soon-to-be-launched NBC Sports Network has already proven that they'll be dedicated to covering hockey in a suitable manner.

Twitter is the great equalizer in all of it, of course, and while I don't have to numbers to back up a claim that hockey fans are some of the most vocal Tweeters, I do know that hockey topics trend worldwide more than the Worldwide Leader In Sports would ever have you believe.

Quality hockey coverage is out there, and in most cases, that coverage is bringing fans closer to the game than ever before. So while it might be frustrating and it might be insulting when ESPN ignores us, especially over highly emotional topics like the most tragic year the sport has ever seen, it's time to realize that it doesn't matter.

No matter what, we're not going to forget. That's what's important.

China says Taiwan's opposition a threat to peace (Reuters)

BEIJING (Reuters) ? China warned Taiwan's pro-independence Democratic Progressive Party on Wednesday that its stance on relations with Beijing could threaten a hard-won state of peaceful coexistence, as the island's closely watched elections draw near.

China has slowly ramped up the rhetoric ahead of Taiwan's January 14 presidential and parliamentary polls, offering both economic incentives for the self-ruled island and making veiled threats that a vote for the DPP would harm vital trade ties.

Beijing will be hoping that pro-China President Ma Ying-jeou, who has signed a series of landmark agreements with Beijing since he became Taiwan's president in 2008, gets back into office and continues his policy of detente.

China has made little secret of its distaste for the DPP, even as its candidate, Tsai Ing-wen, tries to lay out a more moderate line than former President Chen Shui-bian, whose strong support for Taiwan's independence infuriated Beijing.

Speaking at a regular news briefing, Yang Yi, spokesman for China's Taiwan Affairs Office, said a return to those days would be a disaster. The DPP's Chen held office from 2000 to 2008.

"Upholding the 'Taiwan independence' platform of one country on either side of the Taiwan Strait would be a step backward into the era of Chen Shui-bian, and that would inevitably threaten the peaceful development of cross-strait ties," he said.

China and Taiwan have been ruled separately since defeated Nationalist forces fled to the island at the end of the civil war with the Communists in 1949.

China maintains that Taiwan is simply a wayward Chinese province which has no right to seek independence, and it has never renounced the use of force to bring Taiwan under its control.

It has also warned that any attempt by the island to formally announce independence would lead to war, which could also drag in Taiwan's main backer, the United States.

Yang repeated that whoever is in charge on the island must accept the "1992 consensus," referring to Beijing's cherished "one-China" principle, which includes Taiwan as part of China.

Beijing and Taipei agreed to their own interpretations of the "one-China" principle and both sides held landmark talks in Singapore the following year.

But the DPP does not recognize that a consensus was reached then, even as Tsai has said an administration led by her would pursue a "balanced, stable and moderate" policy towards China, shying away from the party's previous strong anti-China words.

"Denying the '1992 consensus' will wreck the basis for cross-Strait consultations, which will of course be unable to continue," Yang said.

"I will not make any comments about the election, (but) we still hope that compatriots on both sides of the Strait will work hard to maintain the current good trend of the peaceful development of relations," he added.

`Underwater' Santa Claus a hit in Mexico

Thousands of children and adults visited the zoo in the city of Guadalajara, capital of the western Mexican state of Jalisco to see the 'underwater' Santa Claus, who dives in one of the fish tanks at the aquarium.

Also known as 'Aqua Claus', the character has become the main attraction between Wednesday and Friday at the Guadalajara Zoo during the current Christmas season, aquarium director Luis Eduardo Quintero told EFE.

'It's the first time we've had this Santa and he's a big hit with the kiddies, who usually imagine the guy coming out of a chimney,' the official said.

Amid algae, stones and fish, the jolly old Christmas elf sparks laughter, surprise and a whole assortment of emotions among the kids watching him.

With the water at a temperature of 10 degrees Celsius to simulate the the frosty North Pole, Santa Claus with his oxygen tube dives underwater in a fish tank to interact with those watching him for 30 minutes.

The youngsters no sooner see him than they run to the thick glass separating them from the fellow with the floating white beard, who, wordlessly, gets them laughing and jumping up and down with excitement.

Santa stands on his head, acts like he's on a sleigh ride, waves a golden bell, asks the kids for their letters to Santa listing their Christmas wishes, asks if they've been good little girls and boys, shows them drawings to see what they want for Christmas, and even poses for souvenir photographs.

Playing one of the best-known characters in the world can't be easy, not just because of the water temperature but because he has to wear a special suit, a belt with between 10 and 20 kg of weights so he can sink to the bottom, and, above all, he needs a scuba-diving certificate.

But it's all worthwhile when you see the kids' reaction, says Gerardo Espinoza Sandoval, one of the zoo's three scuba-diving Santas.

'It's an experience that pays you back because you see the kids' expression that tells you that we still believe in magic and because it makes you remember when you were little,' the Santa, a veterinarian by profession, said.

The success of the underwater Santa Claus has been so great that the zoo's administrators are already thinking about the scenery and set design for next year.

Meanwhile they expect visitors with children to flock to the zoo between Dec 25 and Jan 2 on their Christmas vacation.

"Catastrophic lithium-ion battery failure" are five words Malfunctioning Eddie never wants to hear, and may not have to, thanks to a new sensor developed by the folks at the Johns Hopkins University Applied Physics Laboratory. Despite the popularity of lithium-ion batteries in everything from consumer electronics to hybrid and electric vehicles, they have been associated with a phenomenon called "thermal runaway" -- known to cause overheating and potentially, fire. The newly developed device measures the electrical parameter of the cell, which is an indicator of whether the internal layer temperatures are getting too toasty. The best part? The warning comes before the heat can reach the surface and cause catastrophic failure, perhaps saving our electronics from a fate like the one in the video after the break.

World stocks higher on signs US economy improving (AP)

SINGAPORE ? World stock markets rose Friday and oil jumped above $100 a barrel on signs the U.S. economy is improving.

European benchmarks opened higher after gains in Asia. Germany's DAX rose 0.8 percent to 5,899.02 and France's CAC 40 gained 1.0 percent to 3,102.54. Britain's FTSE 100 was up 0.7 percent to 5,493.22.

Futures augured an advance on Wall Street. Dow futures were up 0.5 percent at 12,159 and S&P 500 futures were higher by 0.6 percent at 1,256.10.

Investors have been cheered in recent weeks by evidence of a rebound in the U.S. ? the world's biggest economy and a crucial export market for many countries in Asia.

The number of people applying for unemployment benefits dropped last week to the lowest level since April 2008, the third week in a row that applications fell. The Conference Board reported that its measure of future economic activity jumped last month, the second straight gain.

Investors were also encouraged by an agreement in the U.S. Congress to extend a payroll tax cut for two months.

Oil futures climbed above the $100 mark as improved growth in the U.S. is expected to boost demand for crude.

China's benchmark in Shanghai gained 0.9 percent to 2,204.78 and Hong Kong's Hang Seng rose 1.4 percent to 18,629.17. Japan's financial markets were closed for a public holiday.

Australia's S&P/ASX 200 jumped 1.2 percent to 4,140.40 in an abbreviated session. Seoul's Kospi added 1.1 percent to 1,867.44 and Singapore rose 0.4 percent to 2,675.12.

Chinese shares were pushed higher by the announcement of government plans to begin construction of as many as 8 million subsidized homes, half of which should be completed next year. Shares in cement, power, and real estate companies led gains.

Traders are also anticipating new policies to encourage lending and economic growth.

"Investors are expecting possible further monetary easing measures, like reducing bank reserve requirements," said Cai Dagui, an analyst at Ping'an Securities in Shenzhen.

Trading volume is normally low during the next week as many investors take vacations over Christmas and New Year. Most global markets are closed Monday for Christmas.

Credit ratings agency Fitch said it expects growth in Asia's developing economies will slow slightly next year but still expand by a robust 6.8 percent, which should help bolster the region's wealthier nations.

"Emerging Asia's resilience provides some support for high-income Asian countries relative to other advanced economies," Fitch said in a report.

Other analysts are more pessimistic. HSBC is forecasting Europe's economy will contract next year by 1 percent while the U.S. grows a weak 1.5 percent as Europe's debt crisis undercuts business confidence.

"Despite signs of greater urgency to deal with the problem, investors remain mostly unconvinced," HSBC said in a report. "This loss of faith is reminiscent of the collapse in confidence in 2008, when the wheels came off the global economy."

"Back then, forecasters completely failed to grasp the gravity of the situation," HSBC said. "The same may be true today."

On Thursday, the Dow Jones Industrial Average rose 0.5 percent while the broader S&P 500 index gained 0.8 percent.

Benchmark crude for February delivery was up 58 cents to $100.11 a barrel in electronic trading on the New York Mercantile Exchange. The contract rose 86 cents to finish at $99.53 on Thursday.

In London, Brent crude was steady at $107.87 on the ICE futures exchange.

The euro was up 0.1 percent at $1.3071. The dollar fell 0.2 percent to 78.04 yen.

MTV News' #5 Newsmaker of 2011 tells 'Home for the Holidays' audience in Toronto that the tune might appear on his next album.

Much like Lady Gaga, Justin Bieber is treating his crew of Beliebers to some new music right in time for the Christmas holiday. On Wednesday night, the pop superstar debuted a new track called "Be Alright" to a jam-packed crowd during his Toronto-based TV concert special, "Justin Bieber: Home for the Holidays," which airs Thursday night (December 22) on MuchMusic and CTV.

"You might hear this on my next album, you might not, but it's a song I'm working on. I still haven't really finished it," Bieber told the screaming crowd, before unveiling the acoustic tune. "Basically, the concept is: Even though when times get hard with your girlfriend or boyfriend, when times get hard, you gotta just let them know that in the end, everything's gonna be alright."

Sitting beside his guitarist, MTV News' #5 Newsmaker of 2011 crooned to the slow jam as the audience clapped their way through his performance, and later on, helped the star sing along to the simple hook. "Across the ocean, across the sea/ Starting to forget the way you look at me now/ Over the ocean and across the sky/ Starting to forget the way you look in my eyes," he sang.

After the holiday special, the teen singer took to Twitter to share his thoughts on the memorable evening, writing, "Tonight was special. No rules. Music, family, friends, fans, charity, and music. Thank you. #HomeForTheHolidays."

"Be Alright" is just a taste of what may come from the singer's next album release. MTV News recently spoke with JB's longtime vocal producer, Kuk Harrell, who discussed his thoughts about the pop star's transition into adulthood.

"The only conversation we've had about Justin's album that we're about to do is it's really important that it's the proper transition because we've seen him [with] 'Baby,' now we're watching him grow up," Harrell told us. "And we can't just throw him into the adult game right away. It has to be the proper transition. There's a record in between."

Wednesday's "M:I:4"'s $8.6M reinvigorates box office (omg!)

LOS ANGELES (TheWrap.com) - "Mission: Impossible -- Ghost Protocol" shot its way to the top of the box office Wednesday, collecting a solid $8.6 million, according to early studio estimates.

By contrast, on the Wednesday before Christmas last year, Universal's "Little Fockers" was the No. 1 film with just $7.1 million.

The strong "M:I:4" showing led a flurry of strong weekday performances by other new films Wednesday.

In its first full day of domestic wide release, Sony's "Girl With the Dragon Tattoo" grossed $3.5 million at 2,914 domestic locations.

Paramount's Steven Spielberg-directed "Tintin," meanwhile, took $2.3 million during its U.S. debut Wednesday. It's playing at 3,087 theaters in the U.S. and Canada.

In its sixth day of release, "Sherlock Holmes -- A Game of Shadows" grossed $4.3 million, continuing a strong rebound after a disappointing first weekend.

Paramount/Skydance's "M:I:4" -- the fourth in the "Mission: Impossible" series -- now has grossed $25.7 million domestically and $85 million internationally.

The PG-13 film, directed by Brad Bird and starring Tom Cruise, opened at 425 large-format screens Friday. Its wide release began at 5 p.m. Tuesday, making Wednesday its first full day of wide release. It is now screening at 3,455 locations.

Warner Bros.' "Sherlock Holmes -- A Game of Shadows," which opened to $39.6 million, has grossed a total of $54 million. The PG-13 movie directed by Guy Ritchie and starring Robert Downey Jr. and Jude Law, is showing signs of strength at its 3,703 locations. The movie took in $4.9 million on Monday, $5.2 million on Tuesday.

Sony's "The Girl With the Dragon Tattoo," David Fincher's R-rated adaptation of Stieg Larsson's novels, opened at 7 p.m. Tuesday. In its first five hours of release, the movie grossed $1.55 million. It more than doubled that in its first full day Wednesday, and has now taken in a total of $5.1 million at 2,914 locations.

Paramount's other new release, Spielberg's "The Adventures of Tintin," opened at 3,087 locations Wednesday and, because it opened in Quebec December 9, now has a North American total of $5.57 million. Internationally, the motion-capture animated movie has grossed nearly $240 million.

This is the weekend Hollywood has been looking forward to. After a wretched few weeks, studios are expecting audiences to return to movies in large numbers.

Still to be released: Fox's comedy "We Bought a Zoo," on Friday, and DreamWorks' World War I drama "War Horse," also from Spielberg, which hits theaters on Sunday. Also Sunday, Summit releases its R-rated sci-fi thriller "The Darkest Hour."

House GOP to reject stopgap payroll tax cut (AP)

WASHINGTON ? With the Senate adjourned for the holidays, House Republicans are moving to shelve a bipartisan two-month extension of the Social Security payroll tax cut that cleared the Senate over the weekend and are demanding instead that their fellow lawmakers return to the Capitol for negotiations.

After a spate of bipartisanship last week, the combatants are back in full-throated warfare over President Barack Obama's payroll tax initiative and other expiring measures, including jobless benefits for almost 1.8 million people who will lose them next month if Congress doesn't act.

Instead of accepting a two-month stopgap Senate measure that would ensure fighting continues into February, Republicans said they would move Tuesday to set up an official House-Senate negotiating panel known as a conference committee. The Senate's top Democrat said he would refuse to negotiate until the House passes the short-term version.

Both sides insist they want to extend the provisions before a Dec. 31 deadline, but that will prove difficult. After overwhelmingly passing a two-month extension Saturday, senators raced for the exits in the belief that the House would see no alternative but to go along. The Senate isn't scheduled to resume legislative work until Jan. 23.

The Senate's short-term, lowest-common-denominator approach would renew a 2 percentage point cut in the Social Security payroll tax, plus jobless benefits for the long-term unemployed, and would prevent a huge cut in Medicare payments to doctors.

But House Republicans quickly erupted in frustration at the Senate measure, which drops changes to the unemployment insurance system pressed by conservatives, along with cuts to Obama's health care law. Also driving their frustration was that the Senate, as it so often does, appeared intent on leaving the House holding the bag ? leaving it no choice but to go along.

"With millions of Americans struggling to make ends meet, it would be unconscionable for Speaker (John) Boehner to block a bipartisan agreement that would protect middle-class families from the thousand-dollar tax increase looming on January 1st," said Senate Majority Leader Harry Reid, D-Nev., who negotiated the two-month extension with Senate GOP leader Mitch McConnell of Kentucky. The 2 percentage point tax cut provides about a $1,000 annual tax cut for a typical earner making about $50,000 a year.

Both sides were eager to position themselves as the strongest advocates of the payroll tax cut, with House Republicans accusing the Senate of lollygagging on vacation and Senate Democrats countering that the House was seeking a partisan battle rather than taking the obvious route of approving the stopgap bill to buy more time for negotiations.

Just a couple of weeks after many Republicans made it plain they thought that the payroll tax cut ? the centerpiece of Obama's autumn jobs agenda ? hadn't worked and that renewing it was a waste of money, Republicans emerged from a closed-door meeting touting their support for the president.

"Do you want to do something for 60 days that kicks the can down the road?" said Rep. Jeb Hensarling, R-Texas. "Or do you want to do what the president asked us to do? And we're people who don't agree with the president all that often."

"I've never seen us so unified," Rep. Louie Gohmert, R-Texas, said as he left a two-hour, closed-door meeting Monday night where Republicans firmed up their plans. He said the payroll tax cut that has been in effect this year failed to create any jobs, but he favored extending it for another 12 months because "it's tough to raise taxes when you're in a down economy."

Congress' approval ratings are in the cellar, in part because of repeated partisan confrontations that brought the Treasury to the brink of a first-ever default last summer, and more than once pushed the vast federal establishment to the edge of a partial shutdown.

This time, unlike the others, Republican divisions were prominently on display.

The two-month measure that cleared the Senate, 89-10, on Saturday had the full support of McConnell, the Republican leader, who also told reporters he was optimistic the House would sign on. Senate negotiators had tried to agree on a compromise to cover a full year, but were unable to come up with enough savings to offset the cost and prevent deficits from rising.

The two-month extension was a fallback, and officials say that when McConnell personally informed Boehner and House Majority Leader Eric Cantor of the deal at a private meeting, they said they would check with their rank and file.

But on Saturday, restive House conservatives made clear during a telephone conference call that they were unhappy with the measure.

Ironically, until the House rank and file revolted, it appeared that Republicans had outmaneuvered Democrats and Obama on one point.

The two-month measure that cleared the Senate required the president to decide within 60 days to allow construction on a proposed oil pipeline that promises thousands of construction jobs. Obama had threatened to veto legislation that included the requirement, then did an about-face.

The president recently announced he was delaying a decision on the pipeline until after the 2012 elections, meaning that while seeking a new term, he would not have to choose between disappointing environmentalists who oppose the project and blue-collar unions that support it.

House passes $1T budget bill, avoids shutdown (AP)

WASHINGTON ? The House has passed a $1 trillion-plus catchall budget bill paying for day-to-day operations of 10 Cabinet departments and averting a government shutdown, while Senate talks on renewing a payroll tax cut and jobless benefits reached a critical phase.

The 296-121 vote to approve the spending measure represented a rare moment of bipartisanship in a polarized Capitol. The Senate's top Republican, meanwhile, raised the stakes in the showdown over the payroll tax cut, insisting he won't back a compromise extension unless the bill includes language aimed at forcing construction of a Canada-to-Texas pipeline.

As negotiations on the payroll tax bill proceeded Friday, Senate GOP Leader Mitch McConnell, R-Ky., said, "I will not be able to support the package that doesn't include the pipeline."

The GOP's pipeline demands added uncertainty to efforts by McConnell and Senate Majority Leader Harry Reid, D-Nev., to quickly reach a deal on a bill renewing payroll tax cuts and jobless benefits for the long-term unemployed.

Negotiators on the payroll tax measure worked behind closed doors Friday in hopes of sealing agreement on how to pay for the measure. Simply extending the current 2 percentage point payroll tax cut would cost $120 billion, while extending unemployment benefits for the long-term jobless and preventing a cut in Medicare payment to physicians would add tens of billions of dollars more.

A House-passed version of the payroll tax bill would give President Barack Obama 60 days to decide whether to build the proposed, 1,700-mile Keystone XL pipeline.

Obama, with the support of congressional Democrats, has announced he will delay that decision until after next year's elections, citing a need to study the impact the pipeline would have on sensitive lands in Nebraska. Obama has threatened to reject a payroll tax bill if it includes language easing work on the pipeline.

The postponement would let Democrats avoid having to choose between two of the party's core constituencies: environmentalists who oppose Keystone and some unions who covet the jobs it would produce.

But McConnell and other Republicans say the project would create thousands of jobs. The company's developer, TransCanada, says it could produce up to 20,000 jobs, while critics say the figure would be fewer than 3,500, including less than 1,000 that would be permanent.

After passing the catchall spending bill House leaders sent their members home until Monday or later, planning to return when the Senate produces a payroll tax cut measure for the House to vote on.

The way was smoother for the compromise spending bill, which passed on a 296-121 vote. It would fund 10 Cabinet-level departments, such as the Pentagon and the Department of Education, and dozens of smaller agencies. It would finance everything from U.S. operations in Iraq and Afghanistan to veterans' services, and from airport security inspections to Congress' own operations.

Reid and McConnell said that even if only the House had approved the spending bill by midnight Friday, the Obama administration agreed there would be no federal shutdown. For extra measure, the House also passed two stopgap spending bills, one to fund the government for a single day and the other for a week.

Agreement on the spending legislation was reached after Republicans agreed to drop language that would have blocked Obama from easing rules on people who visit and send money to relatives in Cuba. But a GOP provision will stay in the bill thwarting a 2007 law, passed during President George W. Bush's administration, on energy efficiency standards that critics argued would make it hard for people to purchase inexpensive incandescent light bulbs.

This year's 4.2 percent payroll tax rate will jump back to its normal 6.2 percent on Jan. 1 unless action is taken by Congress. Few lawmakers want to be blamed for a tax increase that would affect 160 million people.

Extended benefits for long-term jobless people will also expire Jan. 1 without congressional action.

That same day, a 27 percent cut in Medicare reimbursements to doctors would take effect unless lawmakers act, a reduction that could convince some doctors to stop treating Medicare patients.

Obama and congressional Democrats have proposed dropping next year's payroll tax rate to 3.1 percent, but an extension of this year's 4.2 percent rate seems likely to prevail. The payroll tax is the major source of financing for Social Security.

Obama also wants to leave in place the current maximum of 99 weeks of benefits for the long-term unemployed. A payroll tax cut bill approved by the House reduces that total by 20 weeks, which the administration says would cut off 3.3 million individuals. Democrats are hoping to soften if not reverse what's in the House version.

Even without the Keystone pipeline dispute, bargainers had still not reached agreement on how to extend a payroll tax cut through 2012, with major disagreements remaining over how to finance the package.

The spending bill advanced after Democrats blocked a series of GOP assaults on Environmental Protection Agency regulations, though the agency's budget absorbed a cut of more than 3 percent.

GOP leaders did succeed in delays in regulations of coal dust and eliminating federal funding of needle exchange programs.

War costs would be $115 billion, a $43 billion cut from the previous year.

Obama Now Likely to Sign Payroll Tax Cut Bill Despite Earlier Veto Threat (ContributorNetwork)

COMMENTARY | President Barack Obama backslid on two veto threats this week. His first change of heart came with the unchanged National Defense Authorization Act, the second came Friday night on the payroll tax cut extension legislation. Do these decisions reflect changes in the president's policies, are they intended to be politically expedient or is our Commander-in-Chief simply eager to begin his Christmas vacation?

The payroll tax cut extension has been a priority for Obama as a statement from the White House on Dec. 13 reiterated. It falls in place with his stated intentions to help middle class America. If the legislation addressed only the payroll tax cut extension, I would have no issue with the president not vetoing the measure.

But the onerous provision in the legislation, insisted upon by House Speaker John Boehner, R-Ohio, and other Republican legislators relates to the Keystone XL pipeline. Obama had indicated he would make a decision on the pipeline project after an alternate route could be determined. Legislators, through provisions in the payroll tax cut extension bill, will require the president to make a decision on the pipeline project within 60 days of signing the legislation into law.

Obama took a firm stand when the pipeline provision was first mentioned as part of the tax cut extension legislation. After learning that the extension was well-received by Senate leaders, and even though the pipeline provision remained in the bill, the president indicated he would not veto the measure because it prevented tax increases to 160 million Americans.

The Keystone XL pipeline has numerous supporters and detractors and is no small project. I find it offensive that Congress wants a fast answer on this issue. I find it offensive the president has changed his stance on vetoing legislation with provisions that are objectionable to him -- and to the Americans who support him. The president now looks like a schoolyard bully; he's full of bluster until he is challenged.

Thirsty? You may be more inclined to reach for plain old H2O if you knew how many calories are in sugar-sweetened beverages; this is according to a new study led by researchers at the Johns Hopkins Bloomberg School of Public Health. They examined the effect of providing clear and visible caloric information about sugar-sweetened beverages such as soda and fruit juice on the number of sugar-sweetened beverage purchases at neighborhood stores, and found that providing easily understandable caloric information, specifically in the form of a physical activity equivalent, may reduce the likelihood of sugar-sweetened beverage purchases among adolescents by as much as half. The results are featured in a recent issue of the American Journal of Public Health.

"People generally underestimate the number of calories in the foods and beverages they consume," said Sara Bleich, PhD, assistant professor with the Bloomberg School's Department of Health Policy and Management. "Providing easily understandable caloric information?particularly in the form of a physical activity equivalent, such as running?may reduce calorie intake from sugar-sweetened beverages and increase water consumption among low-income black adolescents."

Researchers conducted the study at four corner stores located in low-income, predominately black neighborhoods in Baltimore, Md. For the intervention, one of three caloric information signs were randomly posted with the following information: "Did you know that a bottle of soda or fruit juice has about 250 calories?" (absolute caloric count); "Did you know that a bottle of soda or fruit juice has about 10 percent of your daily calories?" (percentage of total recommended daily intake); and "Did you know that working off a bottle of soda or fruit juice takes about 50 minutes of running?" (physical activity equivalent). They collected data for 1,600 beverage sales to black adolescents, aged 12-18 years, including 400 during a baseline period and 400 for each of the 3 caloric-condition interventions. Researchers found that providing participants with any caloric information significantly reduced the odds of sugar-sweetened beverage purchases by 40 percent relative to the baseline of no information. Of the three caloric-condition interventions, the physical activity equivalent was most effective, reducing the odds of black adolescents purchasing a sugar-sweetened beverage by 50 percent.

Consumption of sugar-sweetened beverages such as soda, sport drinks, energy drinks and fruit drinks has been associated with obesity and is highest among minority and lower income adolescents. According to the Centers for Disease Control and Prevention (CDC), more than one third of U.S. adults and 17 percent of U.S children are obese. Obesity increases the risk of many adverse health conditions including type 2 diabetes, coronary heart disease, stroke, and high blood pressure.

"Because of the inclusion of mandatory calorie labeling in the recent health reform bill, it is critical to explore the most effective strategies for presenting caloric information to consumers on fast food restaurant menu boards," suggest the study's authors.

Olympus open to rehiring ex-CEO Woodford but skepticism reigns (Reuters)

TOKYO (Reuters) ? Japan's disgraced Olympus Corp said Thursday it would consider reinstating its sacked CEO, Michael Woodford, but the gesture failed to erase doubts that it would ever rehire the foreigner who blew the whistle on its crooked accounts.

The maker of cameras and medical equipment said Woodford, an Englishman, would be considered as a candidate for the role of leading Olympus out of a $1.7 billion accounting fraud, one of Japan's worst corporate scandals.

"On what will happen to Mr Woodford, it is certain that he is among the options," said Olympus President Shuichi Takayama, one of the directors who voted unanimously in October to sack Woodford after he had queried the firm's dubious book-keeping.

But there remained serious doubts whether Woodford, who went public with his concerns after his sacking, would be reinstated.

"I think it is unlikely," CLSA analyst Nanako Imazu said. "Why would he (Takayama) want Woodford? ... I don't know the intention of Mr Takayama in saying that."

Takayama, currently the most senior executive after several resignations since Woodford's departure, said he had no plans to meet Woodford who some major Japanese shareholders and lenders privately oppose, according to a banking source.

"As of now, I have no plans to meet," he said.

Takayama has said that he and fellow directors will resign soon, to make way for a new board to be elected by shareholders at a meeting in March or April, and that the board wants to choose its successors before it quits. It has set up an external panel to advise on board candidates and other management issues.

Woodford, however, has attacked the existing board as lacking all credibility, saying it has no right to choose its successors. He is assembling his own team of candidates for a new board with himself at the helm as nominated CEO, a move that raised the prospect of battle for control of the company.

In a comment likely to antagonize Woodford further, Takayama added Thursday that some existing directors might not resign after all. So far, only a few directors have quit, including the former chairman, and a former executive vice president.

"There is no need for those who are not found responsible (of wrongdoing) to resign," he said. When pressed if he would remain, he added: "It is not the stage for me to state this."

NEED FOR FRESH CAPITAL OR TIE-UPS

The next CEO and board of Olympus faces major challenges, starting with a need to repair the once-proud firm's balance sheet, which was revealed Wednesday to be $1.1 billion weaker than had been previously disclosed in its fraudulent accounts.

Olympus shares slumped almost 20 percent after Wednesday's corrected accounts were published, with investors now concerned it might need to merge, sell assets or raise fresh capital.

Takayama said Thursday the company was considering capital and operational tie-ups, among other options, to relieve the pressure on its balance sheet, which was shown to have a very thin layer of equity remaining after the restatements.

Olympus forecast its troubled camera business to make a loss in the current financial years, but said unit sales had grown 15 percent in the six months to end-September, from a year earlier.

The firm, whose main income-earner is its very profitable endoscope business, avoided automatic delisting from the Tokyo Stock Exchange by meeting Wednesday's deadline for producing its overdue second-quarter accounts, giving some initial relief to investors who had feared it might miss the deadline.

However, the 92-year-old firm can still be delisted if the exchange believes the accounting deceit was grave enough.

Woodford said Wednesday he was considering options for recapitalizing Olympus. He did not give an estimate of the sum needed but gave an example of how the firm's strong underlying business would ensure a return on any fresh investment.

"For example, if you put $2 billion into the company, the value of the company would probably go up more than $2 billion," he said in an Internet broadcast.

Woodford said he favored private equity or a rights issue over a strategic alliance, which would rob Olympus of its independence. But rights issues, where existing shareholders can buy more shares on a pro-rata basis, are rare in Japan.

Olympus has lost more than half its market value since it sacked Woodford and the scandal erupted. Two top Olympus executives have been found to have masterminded the scheme to cook the books. These executives have since resigned.

Olympus has been dogged by rumors of bid interest from rivals, such as fellow endoscope makers Fujifilm and Hoya, or from private equity since the scandal broke.

The Tokyo exchange said after the announcements that it was keeping Olympus on its watchlist for possible delisting.

Some of the restated accounts also came with qualified opinions from auditors, with KPMG AZSA LLC noting it had been unable to confirm all the money flows involved in the fraud.

Medical physics is getting heavier. Shooting intense beams of protons into tumors to destroy them while leaving nearby tissues largely unharmed has been in vogue since the ?60s. Globally, however, many centers offering such beam-based cancer treatment, known as hadron therapy, are looking to more massive carbon ions for their unique therapeutic promise. These particles are sometimes able to eradicate tumors that have become resistant to all other forms of radiation.

One interested center is CNAO, an Italian acronym that stands for the National Centre for Oncological Hadron Therapy. On Sept. 22 the facility finished treating its first cancer patient with proton beams and plans to be ready for carbon-ion beams by mid-2012.

?You don?t build such a giant center just for protons,? CNAO technical director Sandro Rossi said. When all the magnets needed to steer the large carbon ions from the hospital?s basement accelerator to the patient are installed, the apparatus will weigh between 1,000 and 2,000 tons. Rossi expects that, in the next decade or so, when the facility is fully operational, 80 percent of its treatments will be with carbon ions, the rest with protons.

The design for the synchrotron accelerator now used at CNAO originated in a study done at CERN from 1995 to 2000. The European laboratory then provided help with key systems of the machine, and experts still share their advice as needed, though none are employed by the medical center.

Both protons and carbon ions offer precision and damage-control advantages over other radiation therapy. Traditional radiation therapy and chemotherapy target a greater portion of the body than hadron therapy, leading to undesirable extra damage and side effects. Due to an energy distribution known as the Bragg peak, protons and carbon ions can be made to deliver the bulk of their impact at a particular depth within tissues: Tumors are pounded while surrounding tissues are largely left alone. Proton beams are so precise that they are often used when tumors lie close to vital organs and surgery is too risky an option.

But while protons may only damage one strand of DNA in a tumor cell, eventually causing its death, carbon ions cripple both strands in the double helix. Thus the heavier carbon ions make a more potent beam and have a better chance to kill cells traditional methods haven?t been able to.

Still, clinical tests of carbon ion therapy remain scanty. Only 6,000 to 7,000 patients in history have been treated this way, which is few in terms of medical statistics for such a procedure, Rossi said. Japan, the world leader in carbon ion treatment, is responsible for more than 90 percent of these patients. Rossi expects that CNAO will begin regular treatments with proton beams at the end of next year and with carbon ion beams some months later, after more trials are complete.

Meanwhile in the U.S., the Mayo Clinic broke ground on its second proton beam facility in Arizona on Tuesday. Only nine other proton centers in the nation are currently operational, though seven more are in development.

?Right now we?re just trying to get our heads around the protons,? said Chair of Radiation Oncology at the Mayo Clinic in Arizona Steven E. Schild about the Arizona facility. No carbon ion treatment centers exist yet in the U.S., though Schild said they?ve been thinking of adding that technology at the Mayo Clinic.

While hadron therapy is the most promising form of radiation available, he can?t be positive this is the future of cancer treatment, he said. ?We?ll see.?

Part of Schild and other U.S. proton pioneers? research will involve cost-benefit analysis of such beam centers, including those that use carbon ions, to see if the initial expenses are ultimately outweighed by the decrease in complications, secondary effects and tumor recurrence using this method. ?What you want to accomplish is the greatest good for the most people,? he said.
